Privacy Statement and Data Protection
I am registered with the Information Commissioner's Office (ICO) which means I need to tell you what data I am collecting from you and what I intend to do with it. What data do I need and why do I keep it? Name and age - I need to be able to identify you from my other client’s. If you or someone else is at serious risk of harm I would need to break confidentiality (as discussed in our contract and agreed in our assessment session) and in order to identify you your GP surgery or the emergency services will need your name and date of birth. Address, email and phone number - I need your address in order to be able to give this to emergency services should you be in immediate danger. I need some way of communicating with you regarding session times and dates. I will try to use your preferred method of contact but if I cannot reach you, I will try other methods. GP details - If you are at serious risk of harm I will need to break confidentiality therefore I need your GP details. In the event of being unable to contact your GP I may call the police. Will I share your data? Who will I share it with and why? I may have to share my notes if they are subpoenaed by court. If you or someone you tell me about is at risk of harm I may have to inform your GP or the police. I do have supervision which is an opportunity for me to discuss my work in a confidential way. Supervision is more about my process than the content of our sessions. You won’t be identifiable by my Supervisor. I will refer to you by your first name only and give enough detail to provide context. How will I store your data? My notes are stored electronically on an encrypted system. Your first name will be kept on my mobile phone which is password protected. Email correspondence is kept only for the purpose of arranging sessions. How long will I store your data for and how will I dispose of it? I will keep your session notes, your name and your unique code for 3 years which is the time frame my insurance company requests I will delete your phone number out of my mobile phone 1 month after our work finishes. Paper-based notes will be kept for 3 years which is the time frame my insurance company suggests I keep records for.
If you are not happy with the way I use your data you can complain to the ICO at or phone them on 0303 123 1113. Consent If you do not consent to me using your data in this way I will not be able to work with you in Counselling. In circumstances where you are at risk of harm to yourself or others, I do not require your consent to break confidentiality. I will always try to talk to you before I break confidentiality but this may not always be possible. For example: If you are at serious risk of harm or you tell me about someone who is, even if you don't agree I will need to break confidentiality.
